AI-Generated Content Liability & Responsibility
PromoMax offers AI-powered tools that automatically generate and publish content, respond to messages and comments, manage business profiles, request and reply to customer reviews, and perform other automated actions on behalf of our customers. These tools include but are not limited to: automated social media engagement and auto-reply systems, business profile management and optimization, review management and response tools, and content generation and publishing tools.
AI Can Make Mistakes. All content, responses, and actions generated by our AI tools are produced by artificial intelligence. AI-generated content may contain errors, inaccuracies, omissions, inappropriate material, or content that the customer would not have personally selected, approved, or published. PromoMax does not guarantee the accuracy, appropriateness, or quality of any AI-generated content.
No Responsibility or Liability. PROMOMAX.AI does not take responsibility for AI-generated responses, content, or actions. We have no control over the specific responses or content that the AI generates. PromoMax, its owners, employees, contractors, affiliates, and partners shall not be held liable for any damages, losses, or harms arising from or related to AI-generated content, including but not limited to: reputational damage, loss of business, loss of customers or followers, account suspension or termination by any platform, legal claims by third parties, or any other direct, indirect, incidental, special, or consequential damages.
Customer Is Fully Responsible. By using any of our AI-powered tools, the customer acknowledges and agrees that they are fully and completely responsible for all content generated, published, sent, or posted through their account. This includes any content that contains errors, inaccuracies, or material that the customer would not have personally approved. It is the customer's responsibility to monitor, review, and approve all AI-generated content before and after it is published or sent, and to delete or remove any content they find objectionable.
Agreement by Use. By using our tools, programs, or services — including enabling, configuring, or submitting settings for any AI-powered tool — the customer agrees to all terms outlined in this disclosure. The customer confirms that they have read, understood, and accepted that they are fully responsible for everything done by the AI on their behalf. If the customer does not agree with these terms, they should not use the AI-powered tools.
Automated Responses & Communications. When AI tools automatically respond to messages, comments, reviews, or other communications on the customer's behalf, the customer understands that these responses are generated without human review. The customer assumes full responsibility for all automated responses and agrees to monitor and correct any responses that are inaccurate or inappropriate.
Third-Party Platform Actions. When our tools post, publish, respond, or take any action on third-party platforms (including but not limited to social media platforms, search engines, review sites, and business directories), the customer understands that these actions are performed automatically. The customer is responsible for ensuring compliance with each platform's terms of service and policies. PromoMax is not responsible for any account suspensions, bans, or penalties imposed by third-party platforms.
Indemnification. The customer agrees to indemnify and hold harmless PromoMax from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from content generated, published, or sent through our AI-powered tools.

Website URL Scanning for Content Creation
When you enter a website URL into PromoMax and click Generate Posts, Create Content, or any similar content-generation button, you authorize PromoMax to access, scan, and analyze the publicly available pages and information on that website.
This scanning is used to help PromoMax understand your business, services, products, branding, location, contact details, website content, and other publicly available business information so our AI can generate social media posts, captions, blogs, videos, marketing content, and related promotional materials tailored to your business.
By entering a website URL, you confirm that you own the website, manage the website, or have permission to use the website for content generation purposes. You also confirm that you authorize PromoMax to scan and use publicly available information from that website to create AI-generated marketing content.
PromoMax does not require access to private areas of your website, password-protected pages, customer accounts, payment portals, or non-public information unless you separately provide that information to us.
If you do not want PromoMax to scan a website, do not enter that website URL into the content-generation tool.
Legal Language Disclaimer
The English version of this Privacy Policy is the legally binding version. Any translations provided are for convenience only and do not constitute legal advice or binding obligations. In the event of any conflict between the English version and a translated version, the English version shall prevail.
Continuous Autopilot — AI Content Generation & Automatic Publishing
PromoMax offers a "Continuous Autopilot" feature that allows customers to authorize the automatic generation, scheduling, and publishing of AI-generated marketing content to their connected social media accounts on an ongoing monthly basis, without requiring the customer's review or approval before each post is published.
AI-Generated Content & Accuracy: All content published through Continuous Autopilot is generated by artificial intelligence. AI-generated content may contain errors, inaccuracies, omissions, or material that the customer would not have personally selected or approved. PromoMax does not guarantee the accuracy, appropriateness, or quality of any AI-generated content.
Customer Responsibility: Customers who enable Continuous Autopilot assume full and complete responsibility for all content published to their social media accounts, including any content that contains errors or material they would not have personally approved. It is the customer's responsibility to monitor and review published content and to delete or remove any posts they find objectionable.
Waiver of Pre-Publication Review: By enabling Continuous Autopilot, customers knowingly waive their right to review content before it is published. Content will be generated and published automatically each billing cycle without any action required from the customer.
No Liability for PromoMax: PROMOMAX.AI shall not be held liable for any damages, losses, or harms arising from AI-generated content published through Continuous Autopilot, including reputational damage, loss of business, account suspension by social media platforms, or any other direct, indirect, incidental, special, or consequential damages.
Data Processing: When Continuous Autopilot is enabled, PromoMax processes the customer's saved campaign preferences (website URL, business description, selected platforms, and call-to-action settings) to generate new content each billing cycle. This data is stored securely and used solely for content generation purposes.
Right to Disable: Customers may pause or disable Continuous Autopilot at any time from their PromoMax dashboard. Disabling will prevent future automatic generation but will not affect content already published.
Text & Image Content Only — No Videos: Continuous Autopilot generates and publishes text-based posts and AI-generated images only. It does NOT create or publish videos. Customers who want videos must create them separately using the PromoMax Video Studio or the Create Posts workflow.
Credit Usage: Continuous Autopilot uses the customer's monthly post credits each time it generates content. It will use as many available credits as needed to create as many posts as possible based on the customer's plan. If credits run out, fewer posts will be generated that month.
Continuous Autopilot Authorization & Liability Waiver (Full Text)
1. AUTOMATIC CONTENT GENERATION AND PUBLICATION. You authorize PromoMax to automatically generate, schedule, and publish AI-generated marketing content to Your connected social media accounts on an ongoing monthly basis, without requiring Your review, approval, or intervention before each post is published.
2. AI-GENERATED CONTENT DISCLAIMER. You understand that all content is generated by artificial intelligence (AI) and may contain errors, inaccuracies, omissions, or material that You would not have personally selected or approved. AI-generated content is inherently unpredictable and may occasionally produce outputs that are incorrect, inappropriate, or inconsistent with Your brand or business.
3. ASSUMPTION OF FULL RESPONSIBILITY. You assume full and complete responsibility for all content published to Your social media accounts through Continuous Autopilot, including any content that contains errors, inaccuracies, or material that You would not have personally approved. You acknowledge that it is Your responsibility to monitor and review the content published to Your accounts and to delete or remove any posts that You find objectionable.
4. WAIVER OF PRE-PUBLICATION REVIEW. You knowingly and voluntarily waive Your right to review content before it is published. You understand that once enabled, Continuous Autopilot will generate and publish content automatically each billing cycle without any action required on Your part.
5. NO LIABILITY FOR PROMOMAX. PROMOMAX.AI, its owners, employees, contractors, affiliates, and partners (collectively, "PromoMax") shall not be held liable for any damages, losses, or harms arising from or related to AI-generated content published through Continuous Autopilot, including but not limited to: reputational damage, loss of business, loss of followers or engagement, account suspension or termination by social media platforms, legal claims by third parties, or any other direct, indirect, incidental, special, or consequential damages.
6. AS-IS SERVICE. The Continuous Autopilot service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement.
7. RIGHT TO PAUSE OR DISABLE. You may pause or disable Continuous Autopilot at any time from Your PromoMax dashboard. Pausing will prevent future automatic generation and publication but will not affect content already published.
8. POST-PUBLICATION REMOVAL. You understand that You can access Your social media accounts directly at any time to delete or remove any posts published by Continuous Autopilot that You do not wish to keep. PromoMax is not responsible for monitoring or removing published content on Your behalf.
9. BILLING CYCLE TRIGGER. You understand that Continuous Autopilot generates and publishes new content on the day Your subscription payment is successfully processed each billing cycle. If a payment fails, no new content will be generated until payment is successful.
10. TEXT AND IMAGE CONTENT ONLY — NO VIDEOS. You understand that Continuous Autopilot generates and publishes text-based posts and AI-generated images only. It does NOT create or publish videos. If You want videos, You must create them separately using the PromoMax Video Studio or the Create Posts workflow.
11. CREDIT USAGE. You understand that Continuous Autopilot uses Your monthly post credits each time it generates content. It will use as many available credits as needed to create as many posts as possible based on Your plan's monthly limit. If You run out of credits, fewer posts will be generated that month.
12. INDEMNIFICATION. You agree to indemnify and hold harmless PromoMax from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from content published to Your social media accounts through Continuous Autopilot.
By entering Your initials in the Continuous Autopilot authorization dialog, You confirm that You have read, understood, and agree to all terms outlined in this Authorization & Liability Waiver.
AI tools, Google Business management, and autopilot
All PromoMax tools, including SEO, AI visibility, website content, social publishing, photos, review replies, and automated profile updates, provide services and informational measurements, not promised outcomes. We do not guarantee rankings, number-one positions, indexing, visibility, improvement, calls, traffic, leads, sales, revenue, or results within any timeframe. Scores are our own measurements, not Google scores or promises.
Enabling an autopilot feature authorizes generation and publication to the connected accounts within the selected settings without approving each item. AI can make factual, tone, intellectual-property, privacy, or compliance mistakes. You must have authority to manage the business, supply accurate information, and accept responsibility for content and actions you authorize, including monitoring published material and removing unsuitable content. Illustrations are not evidence of real jobs, staff, premises, customers, or results. Google verification and genuine customer reviews cannot be fabricated or bypassed.
Automation depends on third-party access, policies, processing times, and service limits. You can switch off autopilot or choose manual approval; disabling does not remove already published material. These disclosures do not waive non-waivable consumer rights or exclude liability where prohibited by law.
To provide these features, business details, review text, generated material, and publishing receipts may be processed by AI and publishing providers. We record account and business identifiers, initials where requested, the exact disclosure text and version, a text fingerprint, selected mode, and a server-generated timestamp for consent history, operation, and dispute handling. Turning off autopilot records the change and does not erase prior authorization records. Retention and data-rights requests follow this Privacy Policy and applicable law.
Third-Party Social Media Connection Disclosure
PROMOMAX.AI uses Zernio, formerly known as Late, as an independent third-party service provider to help customers connect their social media accounts for scheduling and auto-posting features.
When you choose to connect a social media account through PROMOMAX.AI, you may be redirected outside of our website to Zernio or to the applicable social media platform authorization page. By continuing with that connection process, you acknowledge and authorize that your selected social media account connection is being handled through Zernio’s external service, not directly by PROMOMAX.AI.
Zernio is not owned, controlled, operated by, or affiliated with PROMOMAX.AI or VERO AI LLC. We use Zernio only as a service provider to support social media connectivity. Your use of the connection flow may also be subject to Zernio’s own terms, privacy policy, and the terms of the social media platform you connect.
There is no additional cost charged by PROMOMAX.AI to customers for using Zernio as part of the included social media connection feature.

PROMOMAX.AI provides content creation and scheduling tools. We do not guarantee any specific results from the use of our services.
